REQUEST FOR RELEASE OF FUNDS
On or about April 12, 2019 the town of Lebanon Virginia will submit a request to the Virginia Department of Housing & Community Development (DHCD) release Community Development Block Grant Funds under Title I of the Housing and Community Development Act of 1974 (PL93-383) to undertake a project known as the Haysi to Breaks Trail, in Dickenson County.
FINDING OF NO SIGNIFICANT IMPACT
The Town of Lebanon has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Policy Act of 1969 (PL 91-190) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file the above address and is available for public examination and copying, upon request, at the Town of Lebanon between the hours of 9:00 a.m. and 5:00 p.m., Monday – Friday.
PUBLIC COMMENTS
Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to Mark Mitchell, Lebanon Town Manager or Shane Farmer, Sr. Planner at Cumberland Plateau Planning District Commission. All comments received by April 12, 2019 will be considered by Friends of Southwest Virginia prior to authorizing submission of a request for release of funds. Commenters should specify which part of this Notice they are addressing.
RELEASE OF FUNDS
The Town of Lebanon certifies to DHCD that Mark Mitchell, in his official capacity as Town Manager, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to environmental review process and that these responsibilities have been satisfied. DHCD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Town of Lebanon to use Program Funds.

OBJECTIONS TO RELEASE OF FUNDS
DHCD will accept an objection to its approval of the release of funds and acceptance of the County’s certification for a period of fifteen days following the anticipated submission date or DHCD’s actual receipt of the request (whichever is later) only if it is on one of the following bases: (a) that the certification was not in fact executed by the Chief Executive Officer or other officer of applicant approved by the funding agencies; (b) that applicant’s Environmental Review Record for the project indicates omission of a required decision, finding, or step applicable to the project in the environmental review process; (c) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
